Terms and Conditions

Taxation and Duty

Items listed on this website are located in either Australia or the United Kingdom or in some cases in both. 

The prices shown on listings pages include, where appropriate:

a) for products located in the United Kingdom, Excise Duty and VAT at rates currently applicable in the UK; or

b) for products located in Australia, alcohol duty and GST at rates currently applicable in Australia.

For goods exported from either Australia or the UK to a third country, and from Australia to the UK or from the UK to Australia, any duties or taxes payable in the importing country are the responsibility of the customer and must be settled between the customer or their agent and the relevant authority in the importing country. Please see the terms and conditions below that apply to International Delivery

Delivery Restrictions

Due to differing rules imposed by couriers, aviation authorities and local regulatory bodies regarding the national and international shipment of alcohol, MyWhiskyJourneys will deliver only to the following countries and territories:

Please note that the following restrictions apply to our deliveries to the below territories: 
  
British Forces Post Office (BFPO) 
No products with an alcohol-by-volume (ABV) over 24% may be sent to a BFPO address, and so this excludes all whiskies. 
  
Channel Islands, Highlands & Islands of Scotland, Isle of Man, Isle of Scilly and Northern Ireland 
Order must not exceed 10 litres of liquid. 
  
Norway 
No products with an alcohol-by-volume (ABV) over 60% may be sent to Norway. 
  
Taiwan 
Order must not exceed 5 litres of liquid. 
  
USA 
Order must not exceed 8.5 litres of liquid. 
We are unable to deliver to US Military Bases and excluded US States 
 

 

Delivery within Australia of Products Located in Australia

Products located in Australia will be delivered in Australia at a rate of AUS$25 per bottle (and AUS$5 per bottle for additional bottles in the same order), AUS$15 per item for memorabilia and for books.

Delivery usually takes 3-4 days within Australia, but please allow up to 7 days for delivery. If you have not received your order within 14 days, please contact us at info@mywhiskyjourneys.com

We require someone aged 18 or over to be present at the delivery address to sign for acceptance of whisky. 

Goods are despatched by a third-party courier and their terms and conditions apply.

Goods are sent entirely at the customer’s own risk as we are unable to guarantee safe delivery. Insurance may be purchased at an additional charge and should be requested at the time of order.

International Delivery of Products Located in Australia

Products located in Australia will be delivered to other countries at a rate of AUS$100 per bottle for the first bottle and $50 per bottle for additional bottles, AUS$25 per item for memorabilia (unless post-free for small items) and AUS$25 for books.  However, where delivery charges to certain destinations are measurably in excess of this, we reserve the right to request a supplementary payment from the customer who will have the option to cancel the order and receive a full refund.

Please note that products located in Australia sold to overseas residents will be subject to whatever taxes and/or duties are levied on arrival in the destination country.  Payment of taxes and/or duties levied on arrival in the destination country are the responsibility of the customer.  If in doubt, the customer should check with the local Customs office before placing an order.

Overseas deliveries require a lead-time of 10-15 working days for all orders. If you have not received your goods within 21 days, please contact us  at info@mywhiskyjourneys.com

We require someone of legal age under local licensing laws to be present at the delivery address to sign for acceptance of the goods. Goods are despatched by a third-party courier and their terms and conditions apply.

Goods are sent entirely at the customer’s own risk as we are unable to guarantee safe delivery. Insurance may be purchased at an additional charge and should be requested at the time of order.

The customer is wholly responsible for any and all local customs and import duties and taxes attaching to the goods shipped.  The customer warrants and represents to MyWhiskyJourneys that there are no import restrictions applying to our goods and that all such goods shipped to the customer are being legally imported to the customer’s local market, tax and duty paid.  The customer shall indemnify MyWhiskyJourneys from and against the costs of any claim against MyWhiskyJourneys arising from a breach of the customer’s warranty as stated above.

MyWhiskyJourneys, where appropriate, will complete a customs declaration form declaring 'Specialist Collectible Whisky, No Commercial Value' and stating replacement value. Customers may be liable for taxes/duties on products imported into the destination country.

Delivery within the UK of Products Located in the UK

Collectible whisky located in the UK will be delivered in the UK at a rate of AU$18 per bottle.

Collectible whisky sold to UK residents will be sold without further VAT.

International Delivery of Products Located in the UK

Collectible whisky located in the UK will be delivered outside the UK at a rate of AU$100 per bottle for the first bottle and $50 per bottle for additional bottles. However, where delivery charges to certain destinations are measurably in excess of this, we reserve the right to request a supplementary payment from the customer who will have the option to cancel the order and receive a full refund.

Shipping

All prices published on this site constitute an invitation to treat rather than an offer capable of acceptance by any purchaser. Such prices are published in good faith and are believed to be correct. However, MyWhiskyJourneys reserves the right to alter or change prices at any time up until delivery of the product selected.

Any price changes will be notified and confirmed to you via your order confirmation receipt.

All products offered are subject to availability and we cannot guarantee availability of the products listed.

Under relevant Australian and UK law, items containing alcohol can only be ordered by and delivered to those aged 18 or over.

Those who access the site from locations outside Australia and the UK are responsible for compliance with local laws if and to the extent that local laws are applicable.

Goods must be checked by the customer at the time of delivery and any damage notified to MyWhiskyJourneys within 48 hours of delivery. See the Refunds and Returns section for more information.

Goods are despatched to the delivery destination supplied by the customer. MyWhiskyJourneys relies solely on all information supplied by the customer as to the person, destination and method of delivery and makes no independent checks or enquiries.

Goods are despatched by third party courier and their Terms and Conditions apply. If said courier attempts to deliver in accordance with its Terms and Conditions but fails to do so, the goods may be returned to MyWhiskyJourneys. If the goods are so returned, and they are undamaged, the customer may apply for a refund of up to 50% of the purchase price.

The information contained in this website has been prepared in good faith and is believed to be correct at the time of publication. MyWhiskyJourneys makes no representation or guarantee as to the accuracy of any or all of the information on this site.

We are committed to protecting your privacy. We will only use the information that we collect about you lawfully (in accordance with the Data Protection Act 2014 - Australia). Should we ask you to provide certain information by which you can be identified when using this website, then you can be assured that it will only be used in accordance with our Privacy Policy.

Please note: We aim to provide an accurate description of each expression, including drawing attention to any obvious faults such as wear and tear on packaging or labels.

If you have questions arising from the product description or images, please contact us for a more in-depth condition report.

However, due to the age of many bottles and their seals, we cannot guarantee the condition of the liquid nor can we guarantee against failure/leakage in transit.  Insurance during transit can be arranged at the buyer’s expense – please let us know if you would like insurance to be taken out.  Delivery is usually by Australia Post and insurance is charged at cost (2.5% after the first $100 to a maximum of $5000).  For bottles above $5000, other insurance arrangements can be made.

Old bottles of whisky sometimes show, even with all the seals intact, an element of what is known as “neck creep” where the level of liquid has fallen in the neck of the bottle because of evaporation.  This will be evident in the image accompanying the listing.

Refunds and Returns

You are entitled to a replacement or refund for a major failure and for compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods replaced or a refund if the goods fail to be of acceptable quality and the failure does not amount to a major failure.'

If in the event your purchase is faulty, damaged, wrongly described or breaches a consumer guarantee we will readily refund your money or exchange the product upon presentation of your proof of purchase.  Please note that with older bottlings, the cork/closure may have deteriorated, so care should be taken when opening. As such, we cannot guarantee the condition of a bottle's closure and the item is sold as described. Similarly, labels and any packaging may have deteriorated with time.

We will cover the cost of delivery for the return if MyWhiskyJourneys is at fault. That is, if the wrong product is delivered to you or there is a fault with the product.  In all other circumstances, including where you change your mind, the cost of the delivery for the return (if not met by the customer) will be deducted from the refund to the customer. However, no refund will be made if the bottle(s) has/have been opened or in any way tampered with.

In such circumstances, contact us at info@mywhiskyjourneys.com where our team will be able to assist you.  Proof of purchase must be provided to obtain a refund and the product must be in a saleable condition. Saleable condition is defined as “packaging is not damaged and in original condition”.

Please allow 2-3 business days for your refund to be processed after the returned product has been received by us.

Cancellations

You agree that you cannot change or cancel an order after it has been placed. If you wish to change or cancel your order, please contact us as soon as possible at info@mywhiskyjourneys.com   

If your order is still being processed, it might be possible for us to agree to you changing or cancelling your order. Every attempt will be made to accommodate your request. However, no guarantee can be given once an order has been placed.

If we agree to you changing or cancelling your order after it has been shipped, we may do so subject to you providing proof of purchase, to the ordered products being returned in their original condition and packaging and to you agreeing to pay an amount we request on account of our reasonable costs of processing the change or cancellation.

We will accept the return of goods, and issue a full refund, when:

  1. the goods have demonstrably been damaged prior to transit; or 
  2. the goods received by the customer are clearly different from those ordered; and
  3. the recipient has notified us of the fact within 24 hours of receipt.  However, the goods must not be returned unless and until the customer or recipient has:

and

  • MyWhiskyJourneys has accepted the return of the goods, in which case only, MyWhiskyJourneys shall be responsible for the cost of transit by the method specified by us.

A refund will be credited back to your account upon our receipt of the goods.

We reserve the right to amend these Terms and Conditions from time to time without notice and at our sole discretion.
